Mediation Glossary Terms

Arbitration

Arbitration refers to a form of dispute resolution made by a nonbiased third party. Most of the time, this decision is binding. This form differs from mediation because the solution is given directly and is not in the hands of those within the dispute.

Conflict Management

Long-term management of disputes is usually referred to as conflict management. Conflict management is used to control and/or prevent random violence.

Conflict Resolution

This is a term used to indicate a permanent resolution, which has been established by the needs of both parties being addressed.

Consensus

A decision made which has been agreed to by everyone it pertains to. In no way does this does not constitute as an agreement of the majority.

Consent Order

A settlement agreed upon and signed by a judge in the form of a court order.

Impartiality

This term refers to the impartiality a third party must have while assisting in a resolution of conflict. A third party also known as the impartial party must not choose one position over the other. They must also approach the situation and/or confrontation with a neutral mind set.

Mediation

A process formed to have two parties mutually agree upon a resolution for their dispute. Mediation is accompanied by a third party known as a mediator.

Mediator

This is a trained professional who works to help others with their disputes ultimately assisting with their overall resolution. Mediators must play a neutral role during the process while having no right to impose an unwanted decision upon the individuals involved.

Resolution-Resistant Conflict

Resolution-Resistant conflicts include confrontations which are nearly impossible to resolve. This does not mean that a solution is without a doubt not feasible; it simply refers to the high difficulty of the matter.  

Settlement Agreement

A signed document establishing the overall terms agreed upon during the mediation, which both parties consent to abide by.
